Your trust is important to us, this Notice sets out our commitments to safeguarding your privacy and establishes how we will collect, process and store your Personal Data when making a purchase from us.

Within this policy &​ndash;

  • 'Goods' means any products that are advertised and available for purchase from us;

We are providing this information as part of our on-going efforts to provide transparency and fairness by

We pride ourselves on keeping up to date with regard to advances in technology and legal developments which can result in us needing to change our privacy notice, if we make any changes we shall make the new notice available to you.

  3. Who we share the Personal Data with;
  4. Your rights in respect of that Data.

Whether or not you are personally identifiable from the data that we gather, store or process you can be assured the data will only be used in accordance with this notice.

You will be asked to expressly agree to this Privacy Notice, if you do not agree with anything within this Privacy Notice, you must not purchase goods.

1. Your Personal Data

1.1. We will not gather, collect, process or store any Personal Data except &​ndash;

  2. That is necessary for processing an enquiry;
  3. That is necessary for processing an order or for the purchase of goods from you;
  4. That is necessary for delivering goods ordered or purchased from you;
  5. To take the necessary steps to enter into a contract with you;
  6. That is necessary for the performance and administration of a contract or credit account;
  7. For the recording of a financial transaction.
  8. For internal records that we are legally obliged to keep.
  9. To deal with complaints, disputes and legal actions.
  10. Where necessary to protect the vital interest of you or another person;
  11. To send commercial communications from us (including the availability of new Products, special offers and discounts, newsletters, notifications), where you request or consent to such communications.
  12. To send commercial communications from selected partners, associates or affiliates only where you expressly request or consent to such communications.

2. Enquiries

2.1. If you make an enquiry about any Goods or Services, you are required to provide us with your name, company name and an email address.

2.2. This personal Information is processed for

  1. A legitimate interest &​ndash; in order that we can respond to your enquiry; or
  2. To send commercial communications including the availability of new Products, special offers and discounts, newsletters and notifications), except where you opt-out of receiving such communications by clicking the box in the enquiry form; or by clicking the unsubscribe link in the communications; or otherwise informing us that you wish to opt-out.

3. Purchases

3.1. If we accept any order or purchase for Goods or Services then we will collect your name, address, telephone number, email address and the details of your purchase.

3.2. We will use your personal information

  1. For the administration and performance of the contract.
  2. Deliver any goods to you.
  3. For the recording of financial transactions.
  4. For internal records that we are legally obliged to keep.
  5. To deal with complaints, disputes and legal actions.
  6. Where necessary to protect the vital interest of you or another person;

4. Credit Accounts

4.1. If you make an application for a credit account we shall collect your name, company name, address, telephone number, email address and bank details. We may also obtain a Credit Report from a credit reference agency and trade references.

4.2. The personal information will be used for

  1. Confirmation and evidence of identity.
  2. For the consideration of whether to open a credit account.
  3. For the administration and management of your account.
  4. To record orders and financial transactions.
  5. To trace or recover any amounts due to us.
  6. To maintain internal records for orders made and delivered.
  7. To prevent fraud.

5. Processing Payments

5.1. When making any payments to us, all payments are processed by a third party payment processing merchant and in full compliance with all recognised standards and security requirements.

5.2. The payment processing merchant will use full encryption to ensure your payment card information remains secure, this means that orders can only be accepted from web browsers that permit communication through Secure Socket Layer (SSL) technology, it is not possible to place an order via an unsecured connection. Most web browsers support SSL.

5.3. Where our payment processing merchant needs to retain your payment information, for example to make regular payments then they will only be used for the intended process. We do not retain or store any payment card details.

6. Sharing Your Personal Data

6.1. We may use and share your Personal Data with our employees, officers, agents, consultants, suppliers or subcontractors insofar as reasonably necessary

  1. For dealing with an enquiry or making a purchase.
  2. For performance of a contractual obligation.
  3. To the extent that we are required to do so by law.
  4. In connection with any legal proceedings or prospective legal proceedings;
  5. In order to establish, exercise or defend our legal rights;
  6. With the purchaser (or prospective purchaser) of any business, asset or account which we are (or are contemplating) selling.

6.2. We will not share your Personal Data with a third party unless &​ndash;

  1. We are required or permitted to do so by Law or order of a Court.
  2. It is necessary for the performance or enforcement of a contract.
  3. It is necessary for determining whether to enter into a contract with you or opening a credit account.
  4. It is necessary where goods are to be delivered direct from a manufacturer.
  5. It is necessary for the prevention of fraud or other criminal activity.
  6. We are required to for the purposes of establishing, exercising or defending our legal rights.
  7. We are required to by a purchaser in the event of us selling our business or your account.
  8. You expressly permit or instruct us to do so.

7. Your Rights

7.1. You have the right to know

  1. the identity and contact details of the Data Controller and Data Protection Officer (where applicable);
  2. the purpose and legal basis for processing your Personal Data, and where processing is based on the legitimate interests of the Data Controller, what those legitimate interests are;
  3. whether your Personal Data is transferred or processed beyond the EU and that appropriate safeguards are in place;
  4. the right to access your Personal Information;
  5. the right to erase Personal Information;
  6. the right to restrict processing;
  7. the right to portable data;
  8. the right to withdraw consent;
  9. the right to complain.

7.2. The Right of Access

  1. You may require us to provide you with any Personal Information we hold about you. To obtain a copy of any Personal Information we hold contact the Data Controller at Hunters Wholesale, Unit 4, Kelpatrick Road, Slough, Berkshire, SL1 6BW.
  2. This information will be provided free of charge except where a request is manifestly unfounded or excessive (for example it is a repetitive request, or where we need to process large amounts of data) in which case we shall make a charge for our reasonable administrative costs in dealing with the request or refuse to respond but we must provide a justifiable reason for refusing to respond.
  3. We shall provide the requested information within one month of receipt of the request, however where there is a substantial amount of information or it is difficult to collate we may extend this timeframe by one month by providing you notice.
  4. As we take the issue of protecting your Personal Information seriously, we follow strict storage and disclosure procedures which mean that we may occasionally require proof of identity from you prior to disclosing such information.

7.3. The Right to Erase Personal Information

  1. You have the right in certain circumstances to instruct us to erase your Personal Information where
    1. The Personal Information is no longer necessary in relation to the purpose for which it was originally collected/processed.
    2. You withdraw your consent.
    3. You object to the processing and there is no overriding legitimate interest for continuing the processing.
    4. The Personal Information was unlawfully processed or obtained.
    5. The Personal Information has to be erased in order to comply with a legal obligation.
    6. The Personal Information is processed in relation to the offer of information services to a child.
  2. Where you have the right and you issue an instruction to erase your Personal Information we shall use all reasonable efforts to
    1. Inform all third parties to whom we have disclosed your Personal Information of the requirement to erase your Personal Information which they hold;
    2. In the event that your Personal Information has been published online we shall endeavour to ensure that any links or references are also removed;
  3. We may refuse to erase your Personal Information only
    1. to exercise the right of freedom of expression and information;
    2. to comply with a legal obligation or for the performance of a public interest task or exercise of official authority;
    3. for public health purposes in the public interest;
    4. archiving purposes in the public interest, scientific research historical research or statistical purposes; or
    5. the exercise or defence of legal claims.

7.4. The Right to Restrict Processing

  1. We shall, upon your request, restrict the processing of your Personal Information if the following circumstances arise
    1. Where you contest the accuracy of the Personal Information, we shall restrict the processing until we have verified the accuracy of the Personal Information.
    2. Where you have objected to the processing where it was necessary for the performance of a public interest task or purpose of legitimate interests, and we are considering whether our legitimate grounds override your grounds.
    3. When processing is unlawful and you oppose erasure and you request restriction instead.
    4. If we no longer need the Personal Information but you require the information to establish, exercise or defend a legal claim.
  2. Where processing of your Personal Information is restricted, the information shall be stored but no further processing shall occur.
  3. We shall inform any third party to whom we disclosed your Personal Information that the Information is restricted.
  4. We shall inform you when any restricted period comes to an end.

7.5. The Right to Portable Data

  1. Any Personal Information where the lawful purpose for processing is consent or for the performance of a contract; which is stored by us electronically we shall hold that Personal Information in a portable format (readable in a format that will be commonly used on other computer systems) and we shall provide this information to you or directly to another organisation (where technically feasible) upon your request.

7.6. The Right to Complain

  1. If you are not happy with the way we collect or store your personal Information you can make a complaint to the Information Commissioners Office, however we would appreciate you contacting us first to give us the opportunity to provide an explanation or put things right.

7.7. The Right to Withdraw Consent

  1. If you provide your consent to process your Personal Data in a particular way, you may withdraw your consent at any time by informing the Data Controller at the address at the bottom of this policy or clicking the link at the bottom of our webpages, however withdrawing your consent may affect our ability to process orders or purchases of goods.
  2. Upon receipt of a notice withdrawing your consent to process your Personal Data we shall stop processing the Data except:
    1. Where it is necessary for the performance of a contract.
    2. Where there are compelling legitimate grounds for the processing, which override your interests, rights and freedoms; or
    3. the processing is for the establishment, exercise or defence of legal claims; or
    4. where the processing of the Personal Data is carried out under an obligation in law.

8. Automated Processing

  1. We shall not use automated processing of your Personal Data to form or make decisions except where authorised or required by law (for example for the detection of fraud or tax evasion); or you have given your express consent. If we use automated processing you are entitled to request details of the automated process.

9. Data Security

  1. We will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of Personal Data, including storing of data on a secure, password protected and firewall protected servers.

10. Data Transfers Outside the EU

  1. We shall not generally transfer or process any personal data outside the boundaries of the E.U. In the event that any data is transferred outside of the E.U. we shall inform you of the countries where the data takes place and ensure that the country has sufficient security measures and guarantees in place to protect the security of your Personal Data.

11. Complaints

  1. If you have cause or reason to make a complaint about any aspect of our collection, usage, processing, storage, or retention of your Personal Data you can do so by contacting us in any way you chose and making it clear your communication is a complaint.
  2. Methods of communication include by telephone, or email, or post, or using a 'contact us' form on our website (if available).
  3. It will help if you address the complaint to the Data Protection Manager but if you do not it should not delay your complaint.
  4. When submitting a complaint you should include
    • your name and contact details or if you have asked someone to complain on your behalf they should include your name and contact details, their name and address and you must provide written confirmation that they have the authority to act for and on your behalf;
    • the details of your complaint;
    • any documents or evidence to support or help to explain your complaint;
    • the remedy you are seeking;
  5. We will aim to acknowledge receipt of your complaint within 5 days.
  6. We may ask for confirmation of your identity and/or authorisation to act on your behalf if someone is making the complaint on your behalf, this is to ensure that we do not disclose or discuss any of your personal data with anyone except you.
  7. We may ask for more information or documents to clarify or help us to understand your complaint.
  8. We will consider and investigate your complaint and let you know the outcome.
  9. We will aim to resolve your complaint within 30 days, if it is not possible then we will contact you and let you know when you can expect a resolution.
  10. If you are not satisfied with the outcome you can ask us to review our decision by explaining what you believe we misunderstood or got wrong and we will conduct a review of the decision, if possible by someone who did not make the original decision or an independent third party.
